PRIVACY POLICY AND PERSONAL DATA COLLECTION STATEMENTS

I. PRIVACY POLICY STATEMENT

a.  Our Pledge

ESMD respects personal data and is committed to full implementation and compliance with the data protection principles and all relevant provisions of the Hong Kong Personal Data (Privacy) Ordinance. (“the Ordinance”) We therefore make sure that our policies and practices in relation to the collection, use, retention, transfer and access of personal data comply with the strictest standards of security and confidentiality.

b.        Data Collection and Use

For the purposes of carrying out, administering, provisioning of our services (“the Services”) via our Websites, you may be required to provide your personally identifiable information including, but not limited to, you name, gender, age, identity document number, telephone number, fax number, home address, e-mail address, credit/smart card information, interests or favourite activities etc.

The personal data we collect will be used and retained by us for the following purposes and for other purposes required by law from time to time:

(i)                  provisioning, administering of Services;

(ii)                marketing of goods and/or services by us

(iii)               processing of any benefits to you arising out of or in connection with the Services;

(iv)              analyzing, verifying and/or checking of your credit, payment and/or status in relation to the provision of the Services

(v)                processing of any payment instructions, direct debit facilities, and/or credit facilities requested by you;

(vi)              enabling the daily operation of your account and /or collection of amounts outstanding in your account in relation to the Services;

(vii)             enabling us to comply with our obligations to interconnect with other industry practices;

(viii)           to fulfil any other purposes relating thereto.

In addition, we may disclose and transfer your Personal Data to Membership Department of the HK- YWCA for the purpose of carrying our market research, credit assessments, marketing of any goods and/or services.

c.  Right of Access and Correction

Under and in accordance with the Ordinance, you have the right to request access to and correction of your Personal Data, should you wish to access or correct your personal information held by us, please send your enquiry or request to the Data Protection Officer by post or by email. A reasonable fee may be charged for the processing of certain data access requests.

d.       Direct Marketing

If you have once given us your personal data, you may receive from us from time to time telephone calls, email and direct mailings containing promotional materials. If you do not want to receive them, please write to our Customer Services Officer.

e.      Third Party Merchants

We may have on-line stores, clubs or service providers hosted in our Websites which are operated by third party merchants. If you want to use, order or receive any services or products from any of them, please note that any Personal Data you provide, once transferred to the relevant merchant, is beyond our control and thus outside the scope of protection afforded by us.

f.        Disclosure of Information

Normally, we may share your personal data with, or transfer it to, the Membership Department of the HK- YWCA. For details, please refer to our Personal Data Collection Statement set out below. If you do not want to have your information disclosed to any third parties, please write to our Customer Services Officer.

This policy may be updated from time to time so please check this statement periodically.

i.        Security

We secure your personal information from unauthorized access, use or disclosure. We also take appropriate measures to ensure that the information disclosed to us is kept secure, accurate and up to date and kept only for so long as is necessary for the purposes for which it is used.

j.        Cookies

Cookies are small pieces of information that are stored on your computer by the server maintaining and operating the site. They do not compromise your privacy or security as they store a randomly generated identifying tag on our computer. We save cookies on to your computer to enable our site to personalize your future visits. Based on your interests the information helps speed up navigation to help you find the information you are looking for.

II. PERSONAL DATA COLLECTION STATEMENT

We shall keep your Personal Data confidential at all times. Our policies and practices with respect to the collection, use, retention, disclosure, transfer, security and access of Personal Data are in accordance with the Personal Data (Privacy) Ordinance (Cap 486) and are as set out in this Statement.

You agree that your Personal Data provided by you to us may be used and retained by us for the following purposes and for other purposes as shall be agreed between you and us or required by law from time to time:

(i) provisioning of the Services;

(ii) marketing of goods and/or services by us;

(iii) processing of any benefits to you arising out of or in connection with the Services;

(iv) analyzing, verifying and/or checking of your credit, payment and/or status in relation to the provision of the Services;

(v) processing of any payment instructions, direct debit facilities and/or credit facilities requested by you; and

(vi) enabling us to answer your enquiries

(vii) enabling the daily operation of your account and/or the collection of amounts outstanding in your account in relation to the Services

(viii) enabling us to comply with our obligations to interconnect or other industry practices.

(ix) enabling you to carry out online transactions.

Under and in accordance with the Ordinance, you have the right to:

(i) check whether we hold any of your Personal Data;

(ii) access your Personal Data held by us;

(iii) require us to correct any Personal Data which is inaccurate;

(iv) ascertain our policies and practices (from time to time) in relation to Personal Data and the types of Personal Data held by us.

All requests for access to or correction of Personal Data or information regarding policies and practices and types of Personal Data held should be in writing and addressed to our Customer Services Officer whose contact details are set out in I above.

Please note that the Statements may be amended from time to time. Notices regarding amendments will be posted at our homepage to inform you of the effective dates of the amendments. Amendments will not have retrospective effect. We do not accept any liability for any lost profits, lost data or any direct, indirect, special, punitive, incidental, exemplary or consequential damages resulting from any supplements, amendments or deletions of the T&C and Policy and Personal Data Collection Statements.
